Syrian parliament member hit and seized female judge: activists

(Zaman Al Wasl)- Well-informed sources revealed to Zaman al-Wasl the details of the assault on the Syrian Judge Sydra Hanfi by cousin of regime  minister of justice pointing out it exceeded the violations happeneing in the right of judiciary and judges to draw a complete picture of the mafia regime in which the upper word goes to the thugs and their funders.
The sources said Judge Sydra Hanfi head of one of concilation courts in Damascus was exposed to a kidnapping operation and threat with weapon as well as being beaten harmfully few days ago. The severe beatings caused her a brain concussion, contusions and bruises according to an official medical report.

Hanfi was heading to a house rented by Jihad al-Shakheer, former PM. He is the cousin of the regime Minister of Justice Najem al-Ahmad.

According to sources, Hanfi went into the house in the purpose of implementing a judicial detect and said to al-Shakheer she is coming to implement the law and he ironically and snobbishly responded with “Is there a law left in Syria?” he started beating her in the witness of his son and guards causing her several physical damages along two official employees.

That did not suffice al-Shakheer, he detained Judge Hanfi for hours when higher judicial parties intervened.

-Neither rent nor hand over-

The well-informed sources told Zaman al-Wasl that on 10 May the judge Sydra Hanfi head of third civil concilation court in Damascus headed to implement a real estate judicial detect on a residential house in Mashru’ Dumar in Damacus. The house is rented by PM Jihad al-Shakheer and he refused to pay the rent as well as refused to hand it over to his owner.

The judge went there based on a lawsuit by the house owener to claim his house back who Jihad al-Shakheer refuses to give it up in what is similar to a “rape”.

Hanfi was accompanied by reat estate expert Hussein al-Ahmad and register Fatima Maree and lawyer Najah Naser the prosecuter attorney. When Hanafi and the judicial detect committee arrived to the house, al-Shakheer came out to ask the judge of the reason she is coming. She told him the house owner filed a lawsuit against him in her court to evacuate the house since he refuses to pay the rent or hand the house over. She told him she wants to do a judicial detection on the house to implement the law.

Here al-Shakheer snobbishly told her” Why? You do not know who I am?” clarifying his is a PM and he is the regime and leader man. He told her he will not let her do her detection adding she should take her committee and go for her own good.

The judge responded to al-Shakheer reminded him she came to implement the law and she only wants to see the house for a few minutes and then she will leave. She confirmed he can defend himself in the court. Al-Shakheer responded, “is there any law left in Syria?” and he starting cursing her and cursing judiciary and state. He reminded her he is the regime’s man and he offers the state significant services since he has hundreds of thugs whom he funds and support.

The judge noted she will go without implementing the detection on the house, but she will issue a court verdict because he prevented her from doing the detection according to the law. Al-Shakheer attacked Hanfi pointing out his gun to her face.

-Mediation at the perpetrator-

Al-Shakheer was not the only one who attacked, he was accompanied by his son Saleh and several guards of a PM who is posted in Public Freedom and Human Rights Committee at the parliament and who also has a degree in law according to data of PMs.

Saleh al-Shakheer and several mercenaries of his father beat Hanfi and detection committee. They kidnapped them under threat and detained them in a room inside the house.

In a behavior that manifests the regime behavior and the behavior of its men, it was not enough to beat Hanfi, but he called his cousin, the minister of justice Najem al-Ahmad, and told him he arrested Judge Sydra Hanfi while she was stealing gold and money on her detect mission from his house. He arrested her as a ddisciplinary measure.

Meanwhile, the members of the detection committee were able to call the first general lawyer in Damascus and told him what was done to Hanfi and that they are kidnapped and need help. But the response came only after few hours.

After mediation with the perpetrator, Hanfi was released and transported to hospital. The coroner at the hospital confirmed in an official report that the judge suffers from brain concussion and different bruises. The persons who accompanied her also suffer different bruises and injuries.

-They sorted it out-

The incident passed without any procedure taken by the regime regarding Jihad al-Shakheer or his son.

When the first General Lawyer in Damascus Ahmad al-Sayed ordered to start an investigation regarding the incident, Colonel Ahmad Farhat head of Dumar police section he ordered to summon al-Shakheer and his son and ordered to start a police record and take their statements without arresting them.

In the police record, al-Shakheer’s statement repeats what he said of having offered services to the regime and that he is the cousin of minister of justice. He threatened of transferring the judge to another place or sack her accusing her of theft regardless of witness of detection committee who disclaimed his accusations.

In conjunction, Hanfi filed a personal lawsuit against al-Shakheer via her lawyer Qays Ramadan who clarified in the prosecuting text that al-Shakheer committed a felony and witnessed felony against a judge during duty. This is enough to strip him of his immunity as a PM.

Hanfi’s lawyer demanded detaining al-Shakheer and refereeing him to judiciary; however, none of this took place. Al-Shakheer left following an agreement between minister of justice and head of Parliament Jihad al-Laham and they asked head of police in Dumar to sort out the case and ending the police record.

-Al-Ahmad spends from his pocket-

İn the next day, the news of the assault on the judge spread among judges in Damascus and Syria as well as lawyers. The judges agreed to suspend their sessions until al-Shakheer is held accountable and giving justice to their injured friend. İn response, Minister of Justice Najem al-Ahmad fearing further developments called for the judge Sydra Hanafi to his office in the presence of other PMs.

During the meeting, al-Ahmad said he will pay for the hospital and other expenses from his own pocket knowing that judges in Syria do not have medical insurance and do not have the ability to pay medical treatment expenses.

But a group of judges and lawyers felt that what happened to their colleague Hanfi is directed at them and the turn is coming to them one way or another. They kept their stand to hold al-Shakheer accountable and his son. Based on this, the general lawyer of Damascus ordered to summon al-Shakheer and his son Saleh. The sixth investigation judge in Damascus interrogated them on charges of assault and causing deliberate harm on an employee during duty.

The general lawyer made judges angrier since the charges posed at al-Shakheer are considered small offenses. The general lawyer or minister of justice representing judiciary were supposed to file a lawsuit against al-Shakheer on charges of kidnapping a judge and torturing her as well as trying to kill her while she was doing her duty.

The judges were disappointed again and al-Shakheer was left to go to his house without issuing an arrest warrant. His son was arrested in the justice palace instead of being arrested in Adra, central prison in Damascus. Some judges knew later that Saleh al-Shakheer had a room allocated for him in the justice palace supposedly where he should be arrested. He was treated the best way and was receiving friends and visitors.

-Not the first-

The same sources told Zaman al-Wasl that the immunity of funding the thugs and taking care of them is the only immunity that prevented taking al-Shakheer into court and holding him accountable.

It is not the immunity of being a PM. When the regime wants to strip a diplomatic or judicial immunity, it can certainly do that without consulting anyone.

The sources said Minister of Justice Najem al-Ahmad has the same immunity like his cousin or perhaps a stronger one. The big secret that makes Bashar al-Assad keep his minister of justice is the central and effective role of al-Ahmad in sponsoring, recruiting, and funding thugs coming in general from the eastern region of Syria.

Al-Ahmad is considered their godfather and their leader and al-Shakheer cooperates with him in that.

The sources indicated that the assault on the Judge Sydra Hanfi is not the first of its kind regarding Syrian judges. During the past years, many assault cases took place by security forces and thugs. a month ago, a civil court in the city of Shahba in Suwayda province was attacked by a group of mercenaries. They besieged the court for a few hours. A woman was killed by shooting during the incident. Until now, the involved were not arrested since they are related to a group which is above the law.

The judges decided to suspend their work on Sunday to see the results of the investigation with al-Shakheer after the investigation judge decided to interrogate him again under pressure of judges who face pressure from intelligence and regime security apparatuses to silence them out and drop the case, the sources added.

-Al-Shakheer’s record-

The sources confirmed that Jihad al-Shakheer has a criminal record. He was posted in the parliament by an order of Bashar al-Assad himself and he did not gain enough votes to win his seat due to his bad reputation in his province. Zaman al-Wasl investigated the criminal archive owned by the newspaper to verify. Zaman al-Wasl has a criminal archive of about 2.5 million warrants.

The archive revealed that Jihad al-Shakheer the son of Saleh and Saadeh al-Habou is born in Deir ez-Zor in 1974. He was issued two arrest warrants by the Public Prosecution in Aleppo on 7 November 2000 showing that he was fined with 11 thousand SP due to smuggling felony.

The second warrant was issued by Execution Directorate in Deir ez-Zor on 1 January 2012 and he was fined with 49900 SP and if he did not pay, he will be arrested for 90 days.

The regime placed Jihad al-Shakheer in the parliament in the summer of 2013 representing the A strip in Deir ez-Zor province.

Bashar al-Assad himself issued the decree to appoint al-Shakheer in the parliament. The decree number 195 was issued on 6 June 2013. The decree states doing complimentary elections of the vacant seat in Deir ez-Zor province. Jihad al-Shakheer and Hamadi al-Hasani competed over the seat. The regime announced the winner to be Jihad al-Shakheer later on without any objections or appeals on the results of the elections.
