Constitutional Declaration: Criminalizing the glorification of the Assad regime and enshrining the principles of the nation-state

Under the provisions of the new constitutional declaration, the Syrian state affirmed its clear commitment to criminalizing the glorification of the former Assad regime and its symbols, and to considering the denial, praise, justification, or downplaying of its crimes as crimes punishable by law. This step reflects a determination to establish justice and preserve national memory.

It is worth noting that Zaman al-Wasl newspaper was the first to raise the need to criminalize the denial of Assad's crimes and his glorification. This was done in several articles prepared by legal advisor Firas Haj Yahya, who emphasized that true justice begins with acknowledging the facts and criminalizing attempts to obscure or whitewash them.

The declaration also emphasized the rejection of any calls for partition or secession, and considered seeking foreign support or foreign intervention unacceptable and criminalized practices.

In the context of achieving justice, the establishment of a special transitional justice commission was announced, aiming to identify means of accountability and provide redress for victims and survivors.

The declaration included the state's commitment to combating all forms of violent extremism, while affirming respect for public rights and freedoms. It also limited the establishment of a national army to the state, prohibiting any entities or groups from forming military or paramilitary organizations outside its framework.

It also stipulated the protection of the right to political participation and the formation of political parties on a national basis, through a new law that strengthens political pluralism and prevents the return of tyranny.
