Financial Audit Bureau seeks to shield its employees from legal prosecution

Official documents issued by the Central Agency for Financial Control have revealed serious attempts to grant the Agency’s technical staff absolute immunity, shielding them from criminal prosecution or the acceptance of complaints against them—except under complex conditions and with prior authorization.

The documents indicate that the head of the Agency, Mohamed Omar Qadid, received reports regarding lawsuits filed against certain staff members in the technical department responsible for auditing employee financial entitlements; these suits alleged that the staff were obstructing the enforcement of final judicial rulings.

In response, the Agency dismissed the allegations against these employees as baseless, asserting that they were performing their duties impeccably.

To secure this immunity, the Agency head cited Article (17) of Agency Law No. (64) of 2003, which extends the legal provisions governing judges—specifically regarding immunity and disciplinary action—to the Agency’s technical staff.

Consequently, Mohammed Omar Qadid submitted a formal proposal to the Public Prosecutor, requesting the issuance of a directive to judges and public prosecution officials. This directive would mandate that no lawsuits be accepted against technical staff without prior authorization from the Public Prosecutor, in accordance with the mechanism outlined in Article (114) of the Judicial Authority Law.
